Interment Right Conditions

Authority to exercise the interment right

  • Only the interment right holder may exercise an interment right.
  • If the interment right holder is deceased the interment right may be exercised by the personal representative of the deceased interment right holder (by definition the Executor or Administrator of the deceased estate) in accordance with Section 35 of the Burial and Cremation Act 2013.
  • If by definition, there is no personal representative the interment right may be exercised in accordance with Section 31 of the Burial and Cremation Regulations 2014 as follows:
    • by the spouse or domestic partner of the deceased interment right holder; or
    • if there is no surviving spouse or domestic partner – by the eldest living relative of the deceased interment right holder in the following descending order of priority:
      • a child;
      • a grandchild or great-grandchild;
      • a brother or sister;
      • a parent;
      • a grandparent;
      • an aunt or uncle;
      • a nephew or niece;
      • a cousin;
      • any other blood relative.

Monuments – (Headstones and Plaques)

  • Subject to the approval by the cemetery, a monument may be permitted at the site.
  • The interment right holder must engage the services of an authorised Monumental Mason to supply and install an approved headstone for a burial site.
  • The interment right holder must engage the services of Centennial Park Cemetery to supply and install a plaque or other monument for a cremation memorial site or a plaque for a burial site.
  • All monuments must be approved by the cemetery before any work is initiated.

If the interment right is surrendered or cancelled

  • If an interment right has been cancelled and reclaimed by Centennial Park in accordance with the Policies of the Authority or is surrendered, the cemetery may reuse the site in accordance with Section 38 of the Burial and Cremation Act 2013.

Transfer or renewal of the interment right

  • The interment right may be transferred in accordance with the operating policies of the Authority and the Burial and Cremation Act 2013.

Person or persons to be interred / memorialised

  • The interment right holder has the right to determine who may be interred / memorialised in the site as circumstances may require in accordance with the operating policies of the Authority and in accordance with the Burial and Cremation Act 2013.
